TERMS OF USE


Thank you for visiting Antix at antixapp.com (the “Site”) and/or using the Antix application for mobile devices (the “Application”). Please read this statement carefully. It sets out the terms and conditions (the “Terms”) on which you may use the Site and/or the Application. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS THEN YOU SHOULD NOT USE THE SITE OR THE APPLICATION. USE OF THE SITE OR APPLICATION BY YOU SHALL BE DEEMED TO BE YOUR ACCEPTANCE OF THESE TERMS. We may change these Terms from time to time without notice, so please review them periodically when using the Site or Application. Your continued use of the Site and/or the Application will constitute your acceptance of any modification to these Terms.

The Site and the Application are operated by Trick Book Limited (hereafter “Trick Book”, “us” or “we”). Trick Book is registered in England & Wales, with company registration number 08412737 with registered address Parc House, 25-37 Cowleaze Road, Kingston Upon Thames, Surrey, KT2 6DZ, United Kingdom.


GENERAL GUIDELINES FOR SUBMITTING CONTENT

You are legally responsible for any activity that takes place under your username in connection with the Site and the Application, including but not limited to the uploading of videos, images, text, information, data, graphics, comments, photographs and profiles (“User Content”) to the Site and/or the Application.

You will not use the Site or the Application for any unlawful purpose and will comply with all applicable laws in your jurisdiction in relation to your use of the Site and Application.

You will not upload any User Content to the Site or via the Application that:

  1. is unlawful, libellous, defamatory;
  2. is false or misleading;
  3. is insulting, threatening or abusive;
  4. is obscene or of a sexual nature;
  5. is offensive, racist, sexist, ageist or otherwise discriminatory;
  6. encourages violence;
  7. infringes the intellectual property of a third party;
  8. is likely to discredit or damage the reputation of Trick Book;
  9. identifies an individual other than yourself (e.g. a telephone number, email address or physical address);
  10. is technically harmfull (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, corrupted data or other malicious or harmful software, data or components).

Please exercise caution when posting User Content to the Site and/or the Application as you may not be able to remove personal content at all times

We reserve the right to edit or remove all or part of any User Content from the Site and/ or the Application at our sole discretion, without prior notice.

User Content uploaded onto the Site and/or the Application may/may not be hosted by YouTube. Therefore you must comply with their Terms , Privacy Policy, and Community Guidelines

You will not modify or hack the Site or the Application or make unauthorised use of the account of another user.

We reserve the right to alter the Site or the Application at any time without notice.


SUSPENSION AND TERMINATION

We will determine, in our discretion, whether there has been a breach of this terms of use policy through your use of our Site and/or the Application. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this terms of use policy constitutes a material breach of this terms of use policy upon which you are permitted to use our Site and/or the Application, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our Site and/or the Application.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our Site and/or the Application.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.


INTELLECTUAL PROPERTY

The software, graphics and look and feel of the Site and Application and any other user content (“User Content”) belong to us or our licensors and we retain all rights in such User Content. We grant you a limited, revocable, non-sub-licensable licence to reproduce and display the User Content (excluding any software code) solely for your personal, non-commercial use for the purposes of using the Site and/or the Application.

Unless otherwise stated in these Terms, you must not (whether directly or indirectly) (i) copy, download, store, make available, distribute, sell or offer to sell all or any part of the User Content, Site or Application, or (ii) download or otherwise copy, modify, translate, publish, broadcast, transmit, distribute, display or sell any content, files or data from the Site or the Application, including without limitation any User Content uploaded to the Site or via the Application by other users.

By submitting, displaying or posting User Content to the Site and/or the Application you are consenting to the User Content being displayed on both the Site and via the Application.

By submitting, displaying or posting User Content to the Site or the Application, you grant us a perpetual, worldwide, non-exclusive, royalty-free, irrevocable, transferable license (including the right to sub-license) to use, copy, edit, adapt, publish, make available, communicate, distribute, prepare derivative works of, display, perform, modify, delete from, add to, translate or otherwise manipulate your User Content (in whole or in part) in any media formats and through any media channels and for any purpose.

We will use any personal information that we hold about you in accordance with our Privacy Policy , which forms part of these Terms.

Trick Book reserves the rights to remove and permanently delete any User Content, including any edited or summarized videos of any user, without notice, including without limitation any User Content that is in the sole discretion of Trick Book obscene, abusive, indecent, illegal or may otherwise subject us to public disparagement or scorn. As such, you should take care to preserve the originals of your video. You should have no expectation that any edited or summarized videos will always be available through the Site or Services.

Do not rely upon this Site as a storage space for User Content. We encourage you to maintain your own backup of any User Content that you submit through the Application and/or the Site. Antix is not a backup service, and we will not be liable for any loss of, modification, suspension or discontinuation of any User Content offered on or through the Site, including, without limitation, your User Content.


LIABILITY

We are not responsible for any User Content posted on the Site and you use the Site at your own risk.

We accept no liability for any direct, indirect or consequential loss or damage (including loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, or wasted management or office time whether caused by tort (including negligence) breach of contract or otherwise, even if foreseeable), incurred by any user in connection with: (i) the Site or the Application; (ii) the content or accuracy of any User Content posted to the Site or via the Application; (iii) User Content infringing any third party intellectual property rights; (iv) the public use of User Content; (v) the loss of User Content; (vi) your use of, or inability to use, or results of the use of the Site or the Application (including without limitation because of modification, suspension or discontinuation of the Site or the Application due to viruses or any other errors or defects or failures in computer transmissions or network communications); (vii) the content of any other websites that are linked to or from the Site or the Application; provided that this condition does not operate to exclude any liability which cannot be excluded or limited under applicable law.


INDEMNITY

You agree to defend, indemnify, and hold Trick Book, its affiliates, officers, directors, agents, and other partners and employees, harmless from and against any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising from: (i) your use of and access to the Application and/or the Site; (ii) your breach of this Agreement; (iii) your User Content; (iv) your violation of any third party right, including, without limitation, any copyright, property, or privacy right; (v) your violation of any applicable local, state, federal or international law, rule or regulation. This defense and indemnification will survive this Agreement and your use of the Application.


ACCESSING THE SITE OR APPLICATION

We reserve the right to withdraw or amend the service we provide on the Site and the Application without notice. We will not be liable if for any reason the Site or the Application is unavailable at any time or for any period.

The Site and Application rely in part on software to function. Whilst we will monitor the Site and Application and try to fix any technical faults, we cannot guarantee that the Site or the Application, or any individual feature of the Site or Application, will be error free, available all the time and/or free from viruses.


NO WARRANTY

We provide no warranty, whether expressly or implied, of any kind including but not limited to any implied warranties or implied terms of satisfactory quality, fitness for a particular purpose or non-infringement. All such implied terms and warranties are hereby excluded to the extent permissible by law.


SEVERABILITY

If any part of these Terms is, at any time, found to be invalid by a court, tribunal or other forum of competent jurisdiction, or otherwise rendered unenforceable, that decision shall not invalidate or void the remainder of these Terms. These Terms shall be deemed amended by modifying or severing such part as necessary to render them valid, legal and enforceable while preserving their intent, or if that is not possible, by substituting another provision that is valid, legal and enforceable that gives equivalent effect to the parties’ intent.


ENTIRE AGREEMENT

These Terms constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these Terms.


JURISDICTION AND APPLICABLE LAW

These Terms shall be governed by and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes.

PRIVACY POLICY


Thank you for visiting the Antix website at antixapp.com (the “Site”) and/or using the Antix application for mobile devices and non-mobile devices (the “Application”). This Privacy Policy demonstrates how Trick Book Limited (“Trick Book”, “we”, “us”) handle the personal information you provide to us, what we learn about you from your visit to the Site or your use of the Application and how you can control and access the information we hold about you.

By using this Site and the Application and/or registering with us, you are agreeing to the terms of this Privacy Policy. We may modify or update this Privacy Policy from time to time, so please review it periodically. Your continued use of the Site and/or the Application will constitute your acceptance of any such modification. If you have any queries regarding this policy or complaints about our use of your information please contact us at team@antixapp.com and we will do our best to deal with your complaint or query as soon as possible.


PERSONAL INFORMATION THAT WE COLLECT AND RECEIVE

  • Registration details:

    You have to register in order to view content posted on the Site or the Application or upload content to the Site or via the Application. We ask users who register with us to supply us with their name and email address.
  • Profile information:

    Your profile will contain your username and a profile picture. By looking at your profile other users of the Site and Application will be able to see the users who you follow, the users who follow you and, subject to your privacy settings (see below) any User Content uploaded by you.
  • User content:

    We provide a platform for you to post content including images, photographs and other materials (“User Content”) to the Site or via the Application. Other users may access any User Content you submit to the Site or via the Application in accordance with our Terms of Use, subject to any privacy settings that you set. Once you have shared your User Content, it may be re-shared by others. You are able to delete any User Content posted after submitting the content to the Site or via the Application. Any User Content not deleted in this way will remain on the Site and be accessible via the Application indefinitely even if you cease to use the Site or Application. We cannot guarantee the security of any information you submit to the Site or via the Application.
  • Geolocation and Kinematic Data:

    We will collect geolocation and kinematic data from your mobile device when you use the Application. If you do not want to provide us with your geolocation and kinematic data, then we will be unable to provide the functionality of the Application to you.
  • Information We Collect Automatically:

    We may use cookies, web beacons and other devices to collect information about you when you visit our Site and may receive information about you when you use our services. To the extent we associate this information with you on an individual basis, we will consider it to be Personal Information

WHAT WE DO WITH YOUR PERSONAL INFORMATION

By using the Site and/or the Application, you agree that we may use your information (including personal information) for the purposes of:

  • providing our services;
  • verifying your identity (for example when you return to the Site or Application);

  • sending you marketing information in relation to the Site and/or the Application, provided you have consented by “opting-in” to being contacted for this purpose.

HOW WE DISCLOSE PERSONAL INFORMATION

We will not disclose your personal information to third parties without your consent, except as set out in this policy. We may disclose your data to third parties in the following circumstances:

  • Other Users:

    Other users on the Antix Application and/or Site will be able to access your User profile and User Content.
  • Third party service providers:

    We use third parties to provide services and manage the Sites and Application. These may include website hosting service providers and processors. These third-party service providers will be given access only to that information needed to perform their support functions and they are prohibited from using it for other purposes. We require them to enter into reasonable confidentiality obligations.
  • Affiliates:

    We may share your information with a parent company, any subsidiaries, joint ventures, or other companies under a common control with Trick Book (collectively, “Affiliates”), in the event we have such Affiliates in the future, in which case we will require our Affiliates to honor this Privacy Policy;
  • Reorganisation:

    In the event that we or a part of our business undergo reorganisation, enters into a joint venture or are sold to or merged with a third party, you agree that any personal information we hold about you may be transferred to that reorganised entity or third party. You may always opt-out of hearing from these third parties. You will continue to own your User Content in any of these
  • Legal issues:

    In some cases we may be required to disclose your personal information to comply with legal requirements and requests from government agencies.

ANONYMISED DATA

We may remove the parts of your personal data that can identify you and collate it with other anonymised data before sharing it with third parties.

You have a right to access the personal data we hold about you. If you wish to obtain a copy of this information, update your details or remove your personal data from our records, please contact us at team@antix.mobi enclosing your postal details.


SECURITY

We recognise the need to ensure that personal information gathered via the Site and/or the Application remains secure. The Site has security measures in place to protect against the loss, misuse and alteration of the personal information under our control. You acknowledge that although we exercise adequate care and security there remains a risk that information transmitted over the Internet and stored by computer may be intercepted or accessed by an unauthorised third party.
